Terms and Conditions

These terms cover your use of elevaredesigns.com and the design, website, software, SEO and social media services Elevare Designs ("we", "us") provides. By using the site or accepting a quote from us, you agree to them. If you are signing on behalf of a business, you confirm you are allowed to.

A signed proposal or written quote for your project sits alongside these terms. Where the two disagree, the proposal wins for that project.

1. Using this website

You may browse the site, send enquiries and use the package builder for genuine business purposes. Please do not copy the site's design, code or content for your own use, try to break into the admin area, overload the servers, send spam through the forms, or use the site for anything unlawful.

Everything on the site, including text, design, graphics, logos and code, belongs to Elevare Designs or to the clients and people who allowed us to show their work. Client names and logos in our portfolio remain the property of those clients.

2. Quotes and prices

Prices on the site and in the package builder are in Indian rupees (₹) or US dollars ($). Unless a quote says otherwise, they exclude GST and any other taxes, which are added where the law requires. A quote is valid for 30 days.

The package builder gives you a fixed price for the listed scope. Work outside that scope, such as extra pages, new features or content we write for you, is quoted separately before we do it. We never start chargeable extra work without your written agreement, and email or WhatsApp counts as written.

3. Special and festive offers

Offers such as Shop Starter run for a stated period and for a stated number of slots. An offer is only available while its page shows it as open. A slot is confirmed when we have agreed the scope with you and received the advance payment. Unless the offer says otherwise: one offer per business, it cannot be combined with other discounts, and any free extras are part of the offer, not a separate credit. We may decline an offer booking that falls outside the offer's scope, and we will tell you why.

4. Payment

Unless your quote says otherwise, we ask for 50% before work starts and 50% on launch, before final hand-over of files and access. For monthly services (SEO, social media, care plans) we invoice monthly in advance. Indian clients can pay by UPI or bank transfer; international clients by international transfer or a payment link.

If an invoice is more than 15 days overdue we may pause work, and we may take a site we host offline after reasonable written notice. Refunds are covered in the Refund and Cancellation Policy.

5. What we need from you

A project moves at the speed of its content. You agree to send the text, images, logins and approvals we ask for, to reply within a reasonable time, and to check that you have the right to use everything you give us. Our timelines assume that. If we wait more than 30 days for something we need, we may reschedule the project.

You are responsible for the accuracy and legality of the content you provide and of what your business sells, and for any licences, registrations or disclaimers your own industry needs.

6. Revisions and approval

Each package includes the revision rounds it states. Once you approve a design or a page, later changes to it count as new work. A project is complete when it launches, or when you approve it for launch, whichever comes first.

7. Who owns the work

When you have paid in full, you own the final designs, the website content made for you and the code written specifically for your project. You can move it to any host or developer.

We keep ownership of our own tools, templates, layouts, components and know-how that existed before your project or are not specific to you, and we give you a permanent licence to use them as part of your site. Pre-built layouts (for example in Shop Starter or our demo sites) are licensed to you for your business in this way; you own your content and your customisations.

Third-party items such as fonts, stock images, plugins and APIs remain under their own licences, which we will tell you about.

Unless you ask us not to in writing, we may show the finished work in our portfolio and on social media. We never publish your confidential information.

8. Third-party services

Domains, hosting, email, payment gateways, maps, WhatsApp and similar services are provided by other companies under their own terms. We can set them up in your name. We are not responsible for their outages, price changes or policy changes, and their costs are separate unless your quote includes them.

9. Support after launch

Each package includes the support period it states, during which we fix defects in our work free of charge. After that, changes and fixes are charged at our current rates, or covered by a care plan if you have one.

10. What we do not promise

We build websites to rank and convert well, but no one controls Google or your market. We do not guarantee search positions, traffic, leads or sales, and we will never tell you we do.

The site and its content are provided in good faith and "as is". We work hard to keep them accurate, but we do not warrant that the site will be error-free or always available.

11. Limits on our liability

Nothing in these terms limits liability that cannot be limited by law, including your rights as a consumer under India's Consumer Protection Act, 2019, or liability for fraud, or for death or personal injury caused by negligence.

Subject to that, our total liability to you for any project is limited to the fees you paid us for that project in the 12 months before the claim. We are not liable for indirect or consequential losses such as lost profits, lost data you did not back up, or losses caused by third-party services.

12. Ending a project

Either side may end a project by written notice if the other breaks these terms and does not fix the problem within 14 days of being told. You can also end a project at any time for any reason; the Refund and Cancellation Policy explains what is refunded or owed. On ending, you pay for work done up to that point and we hand over what you have paid for.

13. Confidentiality

We keep your business information confidential and use it only for your project. We will sign your non-disclosure agreement if you need one.

14. Law and disputes

These terms are governed by the laws of India. If something goes wrong, please talk to us first and we will try to fix it within 30 days (see Grievance Redressal). If it cannot be settled, the courts in District Kangra, Himachal Pradesh have jurisdiction, without taking away any right you have to approach a consumer commission or the courts where you live.

15. Changes to these terms

We may update these terms. The version that applies to your project is the one in force when you accepted our quote.
